Charlita Mays has a diverse litigation practice that consists of representing clients in complex commercial and financial litigations, securities enforcement investigations, white-collar criminal proceedings, and internal investigations.

Ms. Mays has represented an array of institutions including investment banks, hedge funds, and insurance companies in securities-related civil litigations involving asset-backed securities, distressed debt, and other financial instruments. Ms. Mays has also represented numerous individuals and financial institutions in investigations before the Securities and Exchange Commission, New York Stock Exchange, NASD, FINRA and New York State Attorney General's Office. In addition to representing clients before state and federal courts and regulatory bodies, Ms. Mays has represented clients in arbitration proceedings and mediations.

Notable cases include:

  • with partner David Spears, the representation of a former Morgan Stanley Executive Director in a criminal jury trial in the United States District Court for the Eastern District of New York involving charges of honest-services fraud in connection with Morgan Stanley's stock loan business; representation continues with a pending appeal to the Second Circuit Court of Appeals based on the U.S. Supreme Court's 2010 ruling in United States v. Skilling sharply limiting the use of the honest services fraud doctrine in federal criminal prosecutions;

  • With partner Linda Imes and counsel Justin Deabler, the representation of a former Merrill Lynch employee in a hearing before FINRA's Office of Hearing Officers; Ms. Mays recently argued the appeal of the Hearing Officers' decision before a subcommittee of FINRA's National Adjudicatory Council;

  • Representation of Metropolitan Life Insurance Company a defendant in a civil action in the United States District Court for the Southern District of New York alleging contractual indemnification and federal environmental claims.

  • Representation of Columbia University and Columbia University physicians in connection with civil qui tam lawsuit against New York Presbyterian Hospital.

Ms. Mays is committed to pro bono work. She represented an individual in the United States District Court, Eastern District of New York, in an action for a writ of habeas corpus and won a motion granting the individual an evidentiary hearing.
